Terms of Service
Clean & Simple Laundry Services ("Clean & Simple") is pleased to provide laundry services to you, the member. Subject to your compliance with and acceptance of the terms and conditions set forth below. Please read the following provisions carefully. Your use of the Clean & Simple service indicates your agreement to be bound by the terms and conditions contained herein. If you do not so agree, you should inform us and cease using the service immediately. This agreement is strictly between Clean & Simple and its members and does not in any way constitute or imply any relationship with any other parties.
Laundry pickup must be scheduled in advance by the member. Pickup and delivery will take place as Clean & Simple scheduling allows each week on Monday through Saturday, except on certain holidays determined by Clean & Simple in its sole discretion. Each member is allowed one (1) pickup per week. Clean & Simple reserves the right to determine the pickup and delivery times in its sole discretion and reserves the right to reschedule pickup and delivery times upon prior notice to the member. Delivery will take place at least 24 hours after the time of pickup.
Pick Up and Delivery, Procedure and Terms:
Clean & Simple will provide the member with laundry bags and I.D. tags, each member will also be assigned a number. If a member loses their Clean & Simple laundry bag there will be a charge of $10 per bag lost. Clean & Simple reserves the right not to pick up items that are not in these bags, but may decide to pick up such items in its sole discretion. The member agrees not to include any of the following that are in or attached to any of the items to be cleaned or inside any of the member's laundry bags: (i) non-washable items, (ii) items that are labeled for hand washing and/or dry-cleaning only, or (iii) any other items not meant for laundering. The member is responsible for any and all damage caused by any items left in the member's clothing or laundry bag that cause damage to the clothing of any member, the cleaning machines, or any other property of Clean & Simple or its members. Clean & Simple is not responsible for, and shall not pay for, any loss, damage or theft of items left unattended by the member for pickup or delivery. The member is responsible for ensuring that his/her Clean & Simple laundry bag is in the possession of a Clean & Simple employee.
Missed/Unattended Delivery or Pick Up:
If the member misses a scheduled pickup during a given week, the member will forfeit the service for that week and will not be reimbursed. In order to accommodate the member for the missed week of service, Clean & Simple must have advanced written communication (prior to pickup time) regarding the missed week. Thisallows the member to wash twice as many pounds of laundry the next week as they are normally allowed, free of additional charges. For example, if a member who paid for fifteen (20) pounds per week misses a week, they may have thirty (30) pounds of laundry cleaned the next week.
The member must pay the agreed-upon charges prior to service. Services that have been paid for but go unused do not carry over from week-to-week, or from service term to service term. Clean & Simple will not provide a refund for any under-utilization of services. Except as described in the the Missed Pickup or Refunds paragraphs, all sales are final and all payments are non-refundable.
Clean & Simple will only pickup laundry in Clean & Simple bags. Clean & Simple provides each member with initial laundry bag(s) corresponding to their purchased laundry package (excluding delicate bags). Delicates bags may be purchased on our website for a small fee or provided by the member. Delicates bags must fit and be placed inside the member's laundry bag. Any lost or misplaced Clean & Simple bags will can be purchased on our website. Clean & Simple offers new laundry bags for clients after one year.
When the member signs up for our service your account is automatically set to renew at the end of each term (monthly, etc.).
If a client purchases a promo that specifies a time period (e.g. minimum 2 months or 6 month term, etc.), after the Refund period defined herein, the Client is financially obligated to pay the term even if they cancel the service. New monthly member promos are for weekly service clients.
A customer who has signed up for a membership will have the right to cancel his or her contract within fourteen (14) days of signing up for Clean & Simple service and receive a refund minus a weekly charge for 1/4 of the amount of the member's contracted package for each week since the member signed up for the service, regardless of whether the service has been used. After such fourteen-day period, Clean & Simple shall have no obligation to refund any amounts paid by the member, but it may choose to do so in its sole and absolute discretion.
If Clean & Simple agrees to pay a refund after such fourteen-day period, Clean & Simple will refund the amount paid by the member less (i) a five percent (5%) processing fee, and (ii) a weekly charge for 1/4 of the amount of the member's contracted package for each week since the member signed up for the service, regardless of whether the service has been used. Clean & Simple reserves the right to refuse service to any customer & provide them with a refund.
Clean & Simple is happy to offer a trial service to its potential new customers. The trial service is for 20lbs of laundry for a one time fee. A 20lb C&S laundry bag will be provided to the customer for the extent of the trial. At the conclusion of the trial, customer agrees to allow Clean & Simple to pickup their C&S laundry bag. In situations where a customer does not allow laundry bag repossession, customer agrees to a $10 charge for the laundry bag. Limit one trial service per household, new customers only.
Inventory sheets for each pickup are available at Clean & Simple Inventory Sheet. Inventory sheets are to be used for the sole purpose of keeping track of items. Clean & Simple, in its sole discretion, may chose not to fulfill requests put on inventory sheets. All information provided on the inventory sheets by the member shall be accurate in every way. Clean & Simple is not responsible for any items not listed on the inventory sheets. The member may forego completing an inventory sheet, in which case Clean & Simple is not liable for missing or lost items inside the Clean & Simple laundry bag. If there is a discrepancy between what is listed on any inventory sheet and the actual items left in the bag, Clean & Simple reserves the right change the inventory sheet and, based on a careful examination, make the final determination about the actual contents of the bag without notice to the member. The member hereby consents to any such changes. Clean & Simple does not consent to the accuracy of any inventory sheet completed by the member.
Clean & Simple will use reasonable efforts to maintain a high quality cleaning service. Clean & Simple accepts no liability for damage due to normal cleaning of items without care instructions from the member, and accepts no liability for items treated in accordance with the care labels or other instructions provided. Clean & Simple accepts no liability for "special care" items that require special attention to be cleaned or that do not have care instructions provided in writing by the member. Delicates bag items are washed, dried, & returned "as is" in the delicates bag (unopened, separated, or folded). Clean & Simple is not responsible for clothing bleeding, shrinking, or otherwise changing as a result of normal washing procedures. Precautions should be taken by the member to alleviate these problems via inventory instructions. Clean & Simple reserves the right to refuse to clean any garment. Clean & Simple does not guarantee the removal of stains. Clean & Simple will have its cleaning service re-clean items that, in its sole discretion, were not properly cleaned and have not been worn since they were cleaned. Clean & Simple is not responsible for loss of or damage to any personal or non-cleanable items left in the clothing or laundry bags such as money, jewelry, or any other item. The member agrees not to leave such items in his or her clothing or in its laundry bags.
Loss or Damage:
In the rare instance that your garment is lost or damaged by Clean & Simple, we will issue you a refund or credit for the value of that garment, as specified in the National Fair Claims Guide from the International Fabricare Institute ("IFI"). This guide takes into account the average life of the garment, depreciation for the age of the item, and the current replacement cost. If the member is unable to document the age of a garment, the member can attest to the age but Clean & Simple, in its sole discretion, may limit the minimum age of any garment to one year. If no current replacement cost is available (e.g., because the item is no longer available in stores), Clean & Simple may use the replacement cost of a comparable item currently available. Notwithstanding the foregoing, the maximum reimbursement for each individual item is $25, and the maximum total reimbursement per member is $225.
We are not liable for any preexisting damage to garments. If we find any preexisting damage or have a concern about the colorfastness, or the age, or weakness of the fabric, we may contact you to obtain your approval before proceeding to care for the item. If we are unable to obtain your authorization in a timely manner, then we may return the item without cleaning it.
Missing or damaged items must be reported to us within three (3) days of delivery of the item(s). If you believe that Clean & Simple is in possession of an item but we have no record of its pickup, we request that you inform us immediately so we can start an investigation and you can search at home. If, after seven (7) days, the item has not been found, we may compensate you for the loss of the item in accordance with the IFI guide, at our discretion. Claims for items submitted in a laundry bag will not be honored without an inventory sheet.
Clean & Simple liability shall be limited to general money damages in a maximum amount not to exceed the charges for the term of service paid by the member during the term in which the damages are alleged to have occurred. This liability shall be the extent of Clean & Simple's liability regardless of the form in which any legal or equitable action may be brought and the foregoing shall constitute the member's exclusive remedy. In no event will Clean & Simple be held liable or be responsible for any consequential, special, indirect, incidental or punitive loss or damages, whether or not Clean & Simple knew or should have known of the likelihood of any such loss or damages. Clean & Simple disclaims all warranties, express or implied, with respect to the services rendered to the member.
Venue and Choice of Law:
Any suit involving any dispute arising between Clean & Simple and the member may only be brought to the district court of Taylor County, or in any Texas State Court having jurisdiction over the subject matter of the dispute or matter. Clean & Simple and the member hereby irrevocably consent to the exercise of personal jurisdiction and venue by any such court with respect to any such proceeding. These terms of service and the relationship between the parties shall be interpreted, construed, and governed according to the internal laws of the State of Texas, without reference to its choice of law rules.
